1.Your Terms and Conditions

1.1 This document tells you the terms and conditions on which Motoring & Leisure Services Limited (“we”) sell events tickets to you either through the website www.Boundless.co.uk (“our site”) or through our telephone sales team.  We are a company registered in England (company number 02813598). Our registered office is at Britannia House, 21 Station Street, Brighton, East Sussex BN1 4DE and our VAT registration number is 620 9666 33.  When we sell tickets we act as agent for the event organiser.  The event organiser may impose additional terms and conditions and we will advise you of these prior to purchase.

1.2 Our site is only intended for use by BOUNDLESS Club members (“you”).  We do not accept orders for tickets from individuals who are not BOUNDLESS Club members. We may require you to provide your membership number when making an order for tickets. It is your responsibility to inform our membership services team of any change of your address or other contact details. You may contact our membership services team through our helpline: 0800 66 99 44 (lines open 8am –8pm Monday to Friday, 9am – 5pm Saturday and Sunday).

1.3 Please read these terms and conditions carefully before ordering any tickets from us.  You should understand that by ordering any tickets from us, you agree to be bound by these terms and conditions.  You should print a copy of these terms and conditions for future reference.

1.4 If you are ordering: (a) through our site, please click on the button marked "I Accept" at the end of these terms and conditions if you accept them; or (b) by phone, you will be asked by our sales team to confirm that you accept these terms and conditions. 

1.5 Please understand that if you refuse to accept these terms and conditions, you will not be able to order any tickets from us.

2. INFORMATION ABOUT TICKETS
2.1 By making an order for tickets, you agree that the tickets are to be used only by you and your party.  You are not entitled to resell or transfer tickets to any one outside your party.  If we have reasonable grounds to believe that you have resold or attempted to resell the tickets at a price higher than that you purchased them at, we reserve the right to cancel your order or invalidate your tickets without any further notice.

2.2 Due to the nature of certain events, we may impose age restrictions on entry to the event itself or to ticket type.  We will clearly indicate during the ordering process where an age restriction applies.  Please ensure that you read all the information that applies to the event/Ticket you are booking and we advise that you (and members of your party) bring proof of age to the event, if appropriate.

2.3 We will provide refunds and permit returns if the event is cancelled, moved to another date, or if details of the event are significantly changed after you placed your order.  For the purposes of these terms and conditions, a “significant change” means a change of headline act (concerts only), venue or show time.  For more information about refunds, please refer to paragraph 6.

2.4 Any tickets you order will be at your risk from the time of delivery.  If, however, your tickets are lost prior to delivery we will either send you replacement tickets or arrange for replacement tickets to be available for collection by you at the venue box office.  This may be subject to an administration charge.  We will only permit the venue box office to hand-out tickets to you upon production of your BOUNDLESS Club membership card.

2.5 We recommend that you check all tickets upon receipt.  If you believe we have made a mistake with your order, please contact our helpline (please see paragraph 1.2).

2.6 If tickets are returned to us marked "addressee unknown", we will try to contact you by phone or e-mail.  If we still cannot contact you, we reserve the right to cancel your order.

2.7 In order to prevent fraud, and to protect both you and us, we may contact you after you have made your order and ask you to provide additional information so that we can verify your purchase: this might include, but is not limited to, asking you to provide original credit or debit card statements, attempting to contact you by phone, or making credit reference checks for other fraudulent activity at a particular address.  If we acting reasonably consider that an order is of a fraudulent nature, we reserve the right to cancel the order.  

2.8 You shall be solely responsible for all arrangements relating to your travel to and from, and subsistence and accommodation at, the event.  We will not issue refunds for tickets if you fail to attend the event because of any failure in such arrangements or of the supplier to provide such travel, subsistence or accommodation. 

3. PRICE AND PAYMENT
3.1 The price of any tickets will be as quoted on our site from time to time, except in cases of obvious error.  These prices include VAT but exclude delivery costs, which may be added to the total amount due.  We will advise you as to the delivery costs before we accept your order.

3.2 Payment for all tickets must be by credit or debit card.  We accept payment with Visa, MasterCard, Visa Delta, and Maestro.

4. TICKET COLLECTION
4.1 If we consider it is impractical to post tickets to you because, for example, of the proximity of the event or circumstances beyond our control, we reserve the right to make tickets available for your collection at the venue box office on the day of the event.  In such circumstances, we will endeavour to notify you by phone, email or in writing (using the details you provided at the time of ordering).

4.2 When you collect tickets at venue box office, you must present your BOUNDLESS Club membership card as identification.  The venue box office may refuse to hand-over your tickets if you present identification other than your BOUNDLESS Club membership card. 

5. CONDITIONS OF ENTRY
For the purposes of this paragraph 5, the word “you” shall mean you and members of your party attending the event. 
5.1 When we sell you tickets, we, on behalf of the venue owner and/or the event organiser, grant you a revocable licence to attend the relevant event.  Please note, however, we, the venue owner and/or the event organiser reserve the right to refuse you admission to and/or eject from that event.  Reasons for refusing you admission to and/or ejecting you from the event may include but are not limited to: (a) for health and safety or licensing reasons (including smoking in designated non-smoking areas); (b) behaving  in a manner which has or is likely to affect the enjoyment of other persons at the event; (c) using threatening, abusive or insulting words or mannerisms; (d) if we reasonably consider you are acting under the influence of alcohol or drugs; (e) if you fail, when required, to produce proof of identity or age; (f) carrying offensive weapons or illegal substances; (g) making unauthorised audio, video or photographic recordings; (h) if you breach these terms and conditions; or (i) if your Ticket is invalid.

5.2 We reserve the right to conduct security searches from time to time of you, your clothing, your bags or any other items about your person, and to refuse admission to you, or eject you, from the event and/or venue should you refuse to comply with such security searches.

5.3 We reserve the right to confiscate items of food and drink or any item which in our reasonable opinion may cause danger or disruption to any other persons at the event including but not limited to animals, laser pens, bottles, cans, glass containers, items which may be regarded as weapons, or illegal substances.

5.4 We or the event organiser may invalidate your Ticket if any part of it is removed, altered or defaced or if it is a counterfeit ticket.  We shall also consider any tickets obtained in breach of these terms and conditions to be invalid.  We reserve the right to refuse entry to or eject from the venue any person who attempts to gain entry to an event using an invalid Ticket.  In such circumstances, we may bring a civil claim for trespass.  We do not give refunds for invalidated tickets. 

5.5 You must comply with any and all instructions given to you by venue and/or event stewards.

5.6 You shall not use equipment for recording or transmitting (by digital or any other means) any audio, visual or audio-visual material or any information or data inside any venue or at any event, and you shall not bring such equipment into any venue or event.

5.7 By attending an event, you give your express consent to your actual or simulated likeness to be included within any film, photograph, audio and/or audiovisual recording to be exploited in any and all media for any purpose at any time throughout the world.  This includes filming by the police or security which may be carried out for the security of our other customers.

5.8 We may prosecute you or bring a civil claim if you cause damage to the venue, the venue infrastructure, or cause harm to any other person at the event and/or venue.

5.9 We may at our sole discretion allow you to leave and re-enter the venue during the event.

5.10 If you arrive late, we will make reasonable efforts to admit you to the event at a suitable break (which may be the interval) but we cannot guarantee that you will be admitted.

5.11 If you or members of your party are disabled and/or require the assistance of a carer at the event, please contact us by calling our helpline (please see paragraph 1.2) so that we may assist with your requirements.

6. YOUR RIGHTS TO A REFUND
6.1 If you have purchased tickets to this activity you are not entitled to a refund

6.2 You will be entitled to a full refund (including any booking fee and delivery costs you have paid) if we are unable to fulfil your order for tickets for any of the following reasons: (a) we do not receive the tickets for your order from the event organiser and we cannot arrange for the tickets to be available for collection by you at the venue box office; (b) we despatch your tickets to an address other than one you have previously notified to us and if we cannot, for any reason, provide replacement tickets; (c) we fail to despatch your tickets and do not arrange for your tickets to be available for collection by you at the venue box office; (d) we erroneously despatch incorrect tickets to you for example, the wrong event or wrong type of tickets; or (e) any other similar circumstances to the foregoing and including where we are negligent or we have acted in breach of these terms and conditions; (f) if you are suddenly unable to attend the event due to unforeseen circumstances we may issue a refund if we are notified at least 30 days prior to the event and only if we have not already purchased tickets from the event venue on your behalf.  

6.3 You may be entitled to a full refund (including any booking fee and delivery costs you have paid) if the event organiser: (a) cancels the event or moves it to a date other than that advertised on our site or by the event organiser; or (b) makes a significant change to the event.  In such circumstances, we will use our best endeavours to contact you either by phone, e-mail or in writing (using the details we hold for you) and advise you of the cancellation or significant change. If the significant change is as a result of the event organiser moving the event to a venue other than as we previously advertised and/or changing the date, you may choose to attend the revised event in which case your original tickets will remain valid.  If however, you wish to claim a refund, you will usually need to make your claim at least seven days prior to the revised event or within three days of us notifying you of the change (whichever is the sooner).  We will advise you as to the relevant timeframe when we notify you of the change. 

6.4 If you are claiming a refund under paragraph 6.2 you will need to return the tickets to us. When returning the tickets, we advise that you use a secure mail service which requires signature on receipt (such as “Special Delivery”) we do not accept proof of your postage as proof of our receipt.  On receipt of your tickets, we will process your refund in accordance with paragraph 6.5.

6.5 We will process any refund due to you as soon as possible and, in any case, within 30 days of the day us notifying you of the occurrence of any of the relevant events listed in paragraphs 6.1 and 6.3.  We will usually refund any money received from you using the same method originally used by you to pay for your purchase. 

6.6 Nothing in this paragraph 6 shall affect your statutory rights. 

7. OUR LIABILITY
7.1 As we act as agent for the event organiser our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the total of the purchase price of the tickets you bought together with any applicable booking fee and delivery costs. 

7.2 Nothing in these terms and conditions excludes or limits in any way our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

7.3 We are not responsible for indirect losses which happen as a side effect of the main loss or damage however arising and whether caused by tort (including negligence), breach of contract or otherwise provided that nothing in this paragraph 7.3 shall prevent claims for loss of or damage to your tangible property that fall within the terms of paragraph 7.2.

7.4 Where you buy tickets from a third party seller through our site, the seller's individual liability will be set out in the seller's terms and conditions.

8. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
8.1 We have the right to revise and amend these terms and conditions from time to time.  You will be subject to the policies and terms and conditions in force at the time that you order Tickets from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we confirm your order.

9. YOUR PERSONAL INFORMATION
9.1 We process information about you in accordance with our privacy policy (available to download from www.Boundless.co.uk/privacy). By ordering tickets from us, you consent to such processing and you warrant that all data provided by you is accurate. 

10. LAW AND JURISDICTION
10.1 These terms and conditions will be governed by English law and any dispute or claim arising out of or in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England.
